We are calling on you to ascertain Joseph R. Biden and Kamala D. Harris as the apparent President-elect and the Vice President-elect under the Presidential Transition Act (the “Act”). As business leaders from across the United States, we are concerned that delaying the transition poses serious risks to our nation’s economy and recovery. Your determination will allow for the effective transfer of power.

One of the historic competitive advantages of the United States economy has been our nation’s longstanding commitment to orderly transitions of political power. This tradition, upheld by Democrats and Republicans alike for nearly two and a half centuries, has been crucial in establishing the U.S. as the world’s leading economy. It has given our companies the security and confidence they need to invest, expand, innovate, and plan for the future. We need a transition that enables American businesses to have the confidence they need to bolster a strong economic recovery. Having clarity around government policies is important for business as we plan, hire and allocate resources. This precedent is more important today than ever, as our nation contends with the COVID-19 pandemic and resulting economic downturn. In short, a smooth transition can help save lives, save time, and save jobs.

Ascertaining Joe Biden and Kamala Harris as the apparent successful candidates will not impair President Trump’s ability to contest the results of the election. But it will allow for the government to move forward smoothly during this pandemic.

We urge you to name Joseph R. Biden and Kamala D. Harris as the apparent President-elect and the Vice President-elect so that we can move our country and economy forward with the stability and prosperity that the American people deserve.
