The Constitution gives authority over elections to the states and Congress — not the executive branch. The administration’s March 31 executive order seeking federal control over aspects of mail-in voting is already facing swift legal challenges, with Oregon and Arizona among the first states to file suit, and additional actions expected.
Legal groups, including the Campaign Legal Center, warn the order could disrupt established election systems and risk disenfranchising voters. Legal experts argue the order is probably unconstitutional and unlikely to withstand judicial review. Arizona Secretary of State Adrian Fontes called the move “nothing more than a push to weaponize the sensitive personal information of voters.”
There continues to be no credible evidence of widespread voter fraud in U.S. elections despite Trump’s insistence otherwise. Claims of fraud were repeatedly tested through audits, recounts, and litigation following the 2020 election. All of these affirmed the legitimacy of the results. As former Arizona Republican election official and Leadership Now Award winner Stephen Richer put it, “Nobody has yet produced… evidence of material, contest-altering voter fraud,” underscoring that allegations of widespread fraud remain unsupported by facts.
For business leaders, including Leadership Now members across the country, the concern is not only legal but operational. Prolonged disputes over core democratic processes introduce uncertainty into the system when markets depend on predictability, institutional credibility, and the rule of law.
This latest action from the administration adds to a broader pattern of volatility that is already weighing on economic confidence.
Leadership Now Project supports the organizations and states challenging this order and underscores the importance of protecting clear, lawful, and predictable election systems as a foundation for a strong economy.
